    Hi,

    I need some help regarding an unpaid fine. The court fine was issued by milton keynes magistrates so understand that it needs urgent attention.
    The problem i have is that marston turned up at my mums house on monday. They were advised that they had the incorrect address. I was telephoned and past on my details. At this point i advised them that i had given the court my correct details and that I have not received any mail advising me of the judgement. I did advised the baliff that i had been made redundant. This was also advised to the court when i requested a payment arrangement (before the judgement had been issued).

    Marstons turned up at my door this morning requesting payment in full. Im am still seeking employment and my partner is on income support. We have 2 children to care for. I advised him that i could set up a pyment plan and stick to it and as soon as my employment situation improves i would clear the balance. He would not hear this and said i had to pay half now and the rest before the end of the month or he will be back on monday to collect goods.

    Is there anything i can do? Also the amjority of the goods in the property belong to my partner and when i moved in with her i only brought my gym equipment and also my laptop. Worst case scenario, could i not give them what i own rather than let them take my partners items?

    The distress warrant they showed me today still has my mums address. Does that matter?

        How much is the fine? How much are Marston charging you? I should imagine that these two figures will vary.

        When did you receive the fine? When was the warrant issued?

          hi,
          The original fine was £125 and it was on the 1st may 2009.
          The total outstanding from marstons is £350.
          I haven't received a break down from yet.

              Its a DVLA fine.
              I sold my car but failed to inform the DVLA.
              I did send off the log book but it was not received. IThat makes no difference as i found out that its on my back to prve postage. Expensive lesson for the future i suppose.

                You need to request a breakdown of the fees Marston are attempting to charge you. Use this letter Bailiff - SAR - Legal Beagles

                It will show them that you know your rights and that they cannot charge you what they please. Do not send it recorded either, it is possible they will refuse it. Instead get a (free) certificate of posting from the PO.

                  Im still worried that while i am waiting on a response they may enter the property to remove goods.
                  Is it still possible to ask for a payment plan??

                    In theory a bailiff firm is allowed to break in for non payment of a magistrate court fine, but this is rare.

                    Did you set up a payment plan when you first had notification of the fine? Have you paid anything towards the fine? Can you pay anything now towards the fine?

                      They sent the details to my mums house, and i dont visit as often as i should.
                      I was naive in not following up on the results from the court case, but i never did set up a payment plan and marstons are the ones that informed me of the amount owed.
                      I pleaded guilty in writing but stupidly i did not follow it up and i am greatly regretting it.

                          Thanks alot for your advice. Ill give them a ring and i get the letter sorted and keep you posted.

                          This forum may not clear the debt but it does help clear the fog so we can see whats going on. Thanks again

                            You're welcome and I wouldn't mind betting that Marston will not be able to provide a legitimate breakdown of their fees and so will be forced to reduce them.
