JBW 2 Parking Fines - Final Final warning

  • JBW 2 Parking Fines - Final Final warning

    I received a hand delivered letter for a parking fine this morning, from JBW, i was aware that i had 1 or 2 outstanding, but have had no spare cash, however it has now gone from £168 to £443.66, i phoned Mr Webb (the baliff), asked why it had gone up so much, he said 'my costs', i said 'well i will have to make some sort of agreement to pay as i am income support and currently out of work'. He refused any agreement said that 'i must borrow the money and pay the full £443.66 and that he would give me a week to do so'

    Well i can't pay this, not sure what to do, as i do currently have a car in my name, i guess they will clamp that next week, assuming its in the area? or try to push through the door and take property?

    I also had a 2nd outstanding fine which is currently held at JBW offices(£160), so i decided to phone them up to at least try and pay half of that one off, this month, then half next month, although doing this means i cant pay the other, so as i don't have to deal with the same thing twice, doing so will make life impossible anyway.

    Is it just tough *****, as i am aware, the parking fines and leaving them so long is my fault, do i have to now try and find someone to pay the baliff before next week, as i have had this hand delivered letter stating removal of goods and the baliff refuses to make an agreement, even though the last letter i think said £200, so he has just added another £200 for himself anyway?

    They have never received a signature for reciept of any letters or anything, we did in fact only recently find a couple of the JBW letters among other post in an outside mail box for our house, which some new postman started using, we sondered why we han't been receiving all our mail.

    It is not my first time dealing with baliff's but previously they have given me a lot more room to spread costs or reduce the costs, although that was a council tax baliff, who was actually a nice bloke.

    JBW group don't seem to be interested, i repeated on the phone that i am on income support i can't pay it at once, but i am willing to pay what i have to.

    "My costs" is simply not good enough. A debt cannot increase by more 164% and be justified with the words "My costs" and you should, if possible, record the next conversation you have with this person.

    As detailed in the bailiff guide, at the very least you should request a detailed breakdown of the costs that have been charged. I would strongly suspect that you have been charged for things that the bailiffs are not permitted to charge for.

      I still dont understand why i am not being allowed any option of payment plans, specially considering our finicial circumstances, what am i supposed to do.

      I see the rights they have from the link provided, however i am not clear whether to annoy the ballif and ask for cost breakdown, then no doubt, he will add cost after cost and not allow any space, making things worse.

        The whole point of asking for a breakdown of charges is because the bailiff has to explain how he came to this figure.

        He cannot simply make it up and you need to find out, by way of asking, how he has made up this figure.

          I assume that the parking fines have already been by way of a judgement? Or is it a private company who are chasing you, and this lot are acting on their say so?

            You need to ask the bailiff to explain how an original debt of £168.00 can result in fees of £275.66, such fees representing over 164% of the original debt, when those fees are set out in statute. The bailiffs are aware, but hope that you are not, there is a formula for calculating the scale of fees that may be charged and for the bailiff to charge fees that have not been “actually and necessarily” incurred and are unreasonable and disproportionate to the amount of the debt being collected is de facto unlawful and actionable.

            Once you get the breakdown, you will doubtless find that you have been charged for visits that have never taken place, letters they never sent and the old standby a van visit, which since the bailiffs are there to collect money not goods, is not something that you should be charged for.

              I recently won against jbw for a similar thing. I am waiting for the judge ment. till then if you can hold fire ?
              If you have any sort of problems with bailiffs. I can help you as i am a self proclaimed specialist at dealing with them. I am hopefully going to start a degree (law) from october.                 I think this is a jbw geek in disguise known better as claire riches once head of litigation who left in 2009.

                  Where you say parking 'fine' could you give a little more detail such as where & when etc. Is it council or private??

                    This company usually collects council warrants. Could be they are sneaking in a ppc.
