    Tell him that he will have the chance to persuade a court of this novel and incorrect proposition, but he must understand that when he loses, you will be asking the court to order him to pay your costs.

      Hi atticus

      just an update, managed to get a certificate of cancellation and sent it it bailiff. hopefully that is the end of it.

      clearly courts have made an admin error which has caused a lot of stress - how do we complain about courts pls? and will that be worth doing please from your experience?

          Hi atticus and others,

          This saga continues (brief history, claimant trying to interpret judgement wrongly and demanding rent from each join tenants )

          Since I gave the Certiifciate of cancellation, he has now appointed solicitors who have told me they are now contacting court for clarification. which I believe is a good thing as the matter can be put to bed.

          but, wanted to know what would be the process, will there be a hearing? will courts write to me. and importantly does it give me a chance to counter sue him for the continues harassment over this common sense issue?

            I cannot tell you how to deal with what the court does until we know what that is.

            It is possible that the court will throw out an application on the basis that it is hopeless, without even troubling you. If the court (NB Court, singular) decides that there is something to be considered, the greater likelihood is that it will fix a date and time for a hearing and notify you.

              thanks atticus . it makes sense.

              the landlord has appointed 'settlement solicitors'. for this particular case, what do they file at the court ? or is it just sending a email to them for clarification?

              I am also not sure why solicitors told me they are acting on this case - is it just a ploy to get me to negotiate a settlement on their hopeless case?
              can I also ask them for what they have files with the court? I presumme they need to send me a copy?

              more importantly I would like to know if court decides to revoke the 'certificate of debt cancellation' - they would inform me first right ?

              also what are my options right now please?
