    i bought a car for my wife off ebay a couple of months back, i got a receipt in my name and the sellers name. The v5 was filled in my wife's name so shes the registered keep but the receipt shows that i bought the vehicle. can bailiffs clamp and remove the car for debts in her name as sh's the registered keeper or would proof of me buying the car show enough to prove it belongs to me? im a bit confused with it all as i know ownership is a gray area. tia

    The V5 document is not proof of ownership and it clearly states that on its front page.

    As the car was purchased by you and the receipt is in your name the I would say that is valid proof that you are the owner of the car. The fact that your wife is the driver and is the registered keeper is irrelevant.

    You would need to show that evidence to the bailiff as proof and that should satisfy the requirement of ownership unless there is some other evidence that disproves it.

    It is not a valid argument to claim that because you are husband and wife then she also owns part of the vehicle especially if you can show evidence that purchase was by you. You cannot be liable for your wife's debts and therefore goods owned by you cannot be seized.

    If the bailiff chooses to ignore that, then the bailiff (or potentially their employer) may be liable for unlawful interference with goods and you would have a right to issue legal proceedings for compensation. Any chances of success would require evidence and proof so if you are in that position a starting point might be to record on your phone that the car is clamped as well as showing evidence of ownership and any response from the bailiff - recording the bailiff is not a breach of data protection as there is an exemption for personal affairs so long as it's not shared.

    As a double measure you could also follow up by email or letter to the bailiff company setting out what has happened and what they need to do to rectify it.

      You should print a copy of the ad that shows you bought this, but be warned when it comes to family and purchases then it is a much harder area, you should also print out copies of purchase for both tax & insurance so a date trail is evident.
