      Any goods that are removed and sold must cover a reasonable proportion of the debt after fees have been paid. As far as your mums car is concerned it is worthless and would cost more to remove than it is worth, The Bailiff will know this but hope you don't. I would be inclined to call his bluff over this.

        As for your dads car that may be a little more awkward as it does have a value - could be one of the Bailiffs has his eye on it hoping to get it at a knock down price. He has obviously done himself no favours with his attitude & actions. I assume he does realise he runs the risk of being subject to a Committal Hearing where if found guilty - because he wilfully refuses to pay - could end up serving a sentence and will still owe the debt when released + the added costs from the Hearing. It may be better a solution is found - attachment to benefits possibly, be wary if they own their own home as a charging order could be sought.

        As it is apparent that proof of ownership is an issue he may have to accept it is lost Given the mess he has made and left them in he may have to eat humble pie and would suggest that contact is made with their local Councillor(s) who may be able to thrash out a deal for them. www.writetothem.com

          Slightly off topic but following your father's lifetime search perhaps you could advise him the Bill of rights is rather restrictive as it states "That the subjects which are Protestants may have arms for their defence suitable to their conditions and as allowed by law;"
          So first of all it is limited to Protestants and secondly constrained "by law".
          So for law look no further than the 1953 Prevention of Crime Act which creates a general offence of possessing an offensive weapon in a public place, and there are many more laws which limit the right of protestants (and is that discriminatory? )
          Didn't need to repeal it...just change the law!!!!

            Thank you for all the respones.

            Looks like i will have to write off the money i paid for the car and wait for the house to be sold.

            Last question.

            What do we do with the v5s now ? How do we tell DVLA they are no longer our cars and declare SORN to get road tax back ? Options on DVLA are for selling, scrapping, put in someone elses name.
