  • Locked gate forming the boundary

    Someone has bought the neighbouring property which may have had a right of way over our drive in 1801 but since circa 1960 the boundary comprises fence and a locked gate with no one having access through the gate into my property. The very old padlock was rusty and we put a new one in 2016 for security. Someone has bought it and cut the padlock and put his padlock. Today the gates were open and he was painting the gates on my side! He now claims he has a right of way. Mine is a mixed use commercial/residential property

    Take professional advice. The person advising you will need to see all relevant deeds and documents. You will need to give full details of your grounds for saying the gate has not bben used since circa 1961.It is possible that any right of way has been abandoned through disuse.
