  • HFC Charging Order

    Hi, I have a charging order with HFC. How do I prove the debt has been paid so I can get it removed ? HSBC took over from HFC but when I phoned them I was not on their records. Also Restons solicitors no long have the file as it's over 10 years ago. I'm getting nowhere.

    Please post the exact wording of the entry on the Land Registry title for the charging order.

      other than a disposition by the proprietor of any registered charge
      registered before the entry of this restriction, is to be registered
      without a certificate signed by the applicant for registration or their
      conveyancer that written notice of the disposition was given to HFC

          Can I just check - Are you sole owner or joint owner of the property?

          And are you planning to sell, or do you simply want to tidy up the register?

            My ex wife lives in the house, i haven't for 14 years. I'm trying to remove my name from the mortgage & get it off my credit report, but this Charging order is preventing me. HSBC seem unable to help !

              OK, so the methods of dealing with a Form K restriction on sale won't work.

              Have you tried *writing* to HSBC?

              And if that doesn't work, to the FCA?

                I wrote a letter to HSBC drafted up by a solicitor, this was sent 6 weeks ago & so far no reply.
                So FCA is the next step ?
