  • Claim against me civil money claim

    Hi, I sold a campervan to a gentleman who is now taking me to court for a sum of money for a gear box repair. He has made a whole list of claims about the vehicle which I dispute wholly. I tried to respond to every claim he made but when I tried to submit my response it said "response blocked" Can anyone please advise how l respond with my side of the claim. Thank you.

    I take it that you are trying to do that via MCOL online?

    Did you Acknowledge Service of the Claim, so that's within 14 days of the date on the Claim form?

    That gives you an extra 14 days to file your Defence, so 28 days.

    What's that issue date on the Claim form?

      Hi, thank you for reply. It's a claim via online civil money claim. I'm trying to fill out the form to dispute all parts of the claim. I responded to all 15 issues the claimant brought up on his claim but when I tried to send it it said response is blocked.
      The box on the form says give brief details of why i dispute the claim. If i just say im disputing the claim in full and the reason why will i get a chance to submit my full response later. Ive never been to court before and I'm not in a position to afford a solicitor as I'm retired.

          Please google and read MCOL Guidance and Practice Direction 7C

          You can email your Defence to the court and email a copy to the Claimant. The court's email address is provided on PD 7C

          Don't forget to put the Claim number on the email as well as on each page and the Claimant and Defendants names on the front page.

          You must end your Defence with a signed and dated Statement of Truth

            I rang the court helpline today and was sent a form via email to add my dispute of the whole claim. I have written a response to each of the accusations but I am not sure if I have done everything correctly. Any help would be appreciated thank you.

              Why don't you post up your draft response for others to comment on?

              Can you list his Particulars of Claim so we can see what it actually is you are defending?
