Need help with unfair McDonald’s PCN – GroupNexus/DCB Legal court claim

Hi all – I’m being taken to court by DCB Legal for a PCN issued while I was waiting in a McDonald’s drive-thru bay in Weymouth (Jubilee Retail Park). I never left the site and was just waiting for food as instructed. I’ve got proof of my order and receipts, and McDonald’s even admitted this happens to others and that they can’t retrieve CCTV now.




I’ve noticed the signage and rules have changed loads over the years (it used to be 2 hours max, now it’s confusing). GroupNexus hasn’t responded to my DSAR and are pushing ahead with the claim.




I’ve filed my defence and am now at the Directions Questionnaire stage. Has anyone dealt with this before? I really feel this is predatory and want to push back — possibly even counterclaim.




Any advice or experience is welcome!

As you have already filed a defence it is difficult to see how we can be of any substantial help

In any case we would need to see the wording on the signs at the time of the incident, copies of the NTK. the claim form and your defence before commenting

If you are unsure about competing any parts of the DQ et us know, and we can check your witness statement for you.

You mention making a counterclaim ... what would be the cause of action and what remedy would you be seeking?

Thanks very much for your response and advice.




I’m happy to share copies of the Notice to Keeper, the claim form, and my defence (with personal details redacted).

I don’t have photos of the signage exactly at the time of the incidents, but I do have before and after photos showing how the signage has changed, including from Google Street View.




I would really appreciate your help with completing the Directions Questionnaire and drafting a witness statement to support my defence.
