  • Need advice- claimant refusing to accept their own offer?

    Can the claimant refuse or decide to ignore one of the resolutions they have offered in their claim, after the defendant wants to accept the offer?

    So on a claim, the claimant has made 2 offers for resolution of the claim before the court date.

    It's for possession of an item.

    For eg if item is worth £400, the claimant put on the claim option 1 is give back item, option 2 is pay them £400 for item.

    Defendant wants to take offer 2 and asked for payment details to make immediate payment.

    Claimant has now said they'd 'prefer' option 1, after weeks of ignoring the request.

    Item has no more value to the claimant than as above (they are an organisation). There is no benefit to going to court for them, they won't get more- they risk actually getting nothing due to our evidence.

    Won't this make them look as if they wanted to cause distress with court action/loss of item, more than actually resolve the issue?

    Sorry about being vague about what it is, but we have a seperate case against them as well, and would not be surprised if they intended to cause us stress deliberately due to this.

    Put your offer in writing, saying that if it is refused you will show it to the court.

    Have you filed a Defence yet? If not, make sure your Defence says that you agree to pay the monetary sum claimed, and that you have offered this but the claimant has refused.
