Hi all I need I bit of advice....i am trying to do a voluntary termination but the finance company are telling me I need to do a voluntary surrender as agreement had been terminated previously by them even though I called them and got a payment plan put in place...can they do this?

If the agreement has terminated previously, then you can't VT but at the same time, you can't really do a voluntary surrender either because that also implies that the agreement is still ongoing.
Did you receive notification that the agreement has terminated?
Did you also receive a default notice?
