  • Appeal decision of instant dismissal

    Hi all,

    I am in the position of having been instantly dismissed - after 20 years - for gross misconduct. I have the right to appeal within 7 days. I DO NOT want to go to a tribunal or any such court hearing, as the stress so far has been quite enough! However I would like to appeal the decision, as I think instant dismissal was unduly harsh for the offence I was accused of. My question is - If I appeal the decision, asking for a settlement payment and a neutral reference, must the company simply say yes or no? Would they have the power to take it any further through courts or hearings? The very thought of such proceedings is stressing me out and may prevent me from lodging an appeal.

    All depends on the curcumstances of the instant dissmisal.

    The company may negoteate to save any legal fees or adverse publicity, but thats not something you should depend on, unless they have made a glearing error with you dissmisal.

    Would they have the power to take it any further through courts or hearings?
    Again, depends upon the curcumstances and reason for the dismisal, sometimes, when a person has made a mistake ( bad one ) a company might agree to dismiss them, but not take any further action, but if the person takes action against the company, they can take whatever issue they had for the dismissal further.

    Ask yourself, From there perspective, was they justifed to act like they did ?
    From Your perspective, do you think from your side/persepctive, they acted wrong totaly worng, or just a bit ?

    Iether way, you would only get a informative answer from a solisitor in these curcs becuase its the only place you would be able to disclose all the details, There are a number of posters on here that know what they are doing around these issuse, just give them a few days to read an answer. If you feel that you want to speak to a solisitor, they will advice you how to go forward

      Thanks for the response, I want to appeal the decision, but can't face tribunal or court time...
