  • Can half cousins inherit it there a full Cousins living

A cousin has died and his nearest immediate family are cousins. Does a half cousin also inherit?

    Hi welcome to Legal Beagles

I am sorry for your recent troubles, please send love and condolences to your family.

To help more could you give us a few more details, the obvious one being is there a Will?

Did your cousin express any wishes with regards to their estate?

What is the value of the estate (roughly)?
PLEASE NOTE: I work irregular hours including nights and sleep in shifts. If I have not responded in 48 hours, please ask an admin to Messenger me!

          Hi Dbass,

As there is no Will then the rules of intestacy have to be followed. This may help: https://www.citizensadvice.org.uk/fa...-of-intestacy/

If someone dies without leaving a Will the following are entitled to the estate in the order shown:
          • husband, wife or civil partner
          • children, grandchildren, great grandchildren
          • mother or father
          • brothers or sisters who share both the same mother and father, or their children (nieces and nephews)
          • half brothers or sisters or their children (nieces and nephews of the half blood or their children)
          • grandparents
          • uncles and aunts or their children (first cousins or their descendants)
          • half uncles and aunts or their children (first cousins of the half blood or their children)
A first cousin of the deceased, for example, would only be entitled to share in the estate if there are no relatives who are higher in the order of entitlement.
Children are only entitled to share in an estate if their parent died before the deceased, in which case they take their parent’s share of the deceased’s estate.

Can you explain the half cousin relationship a bit further? If they are a child of a sibling of the deceased who pre-deceased this person then there children would be entitled to the parent's share.
