    Hi all,

    I am in need of help regarding a CCJ that has been made against my husband by Lowell Solicitors. They sent the claim through a couple of weeks ago and before I could send any letters to them he has received another letter from the saying as we didn't reply to the claim or contact them the court has now ordered him to repay the debt:

    Instalment amount -£50.00
    Frequency - Monthly
    First payment date - 21/09/2017

    The debt was originally with JD Williams I think going back to 2008 and is for £556.02. Stupidly at the time we got into trouble with money and rather then pay our debt we instead fed at the time our newborn and paid rent etc.

    Do I still need to send a CCA and a CPR or is it too late?

    Is the letter from the court?

    Did you get the claim form and if so did you actually acknowledge it online?

    If a CCJ has been awarded it is too late to send a CCA request or indeed a CPR request.

    If there is a good reason why you didn't get the claim form you could ask them to agree to a set aside but that will cost money

    If you pay the whole balance off within 28 days of the date of the judgement it will not appear on your credit file

      Yes he got the claim form but didn't get a chance to acknowledge it as within I think a week or so they sent the letter saying a payment plan had been set out.

      We're unable to pay the full amount so is it worth doing the payment plan?

        If you have a CCJ registered against you (your husband in this case) you have 28 day to pay the balance from the date is was awarded so the CCJ is then not put against your credit file.

        You may have grounds for set aside as they have issued proceedings but then sent a misleading letter maybe.
