    hi i am after advice my neighbour keeps cutting my plants down i called the police begining of yr they told her to stop i was adviced to get cctv. Well she has completely killed my 9 ft yucca tree now and i have her on cctv standing on a step ladder leaning over her fence with a pair of loppers cutting all my plants down im mad as i rang police and they told me to stop wasting there time didnt even come and look at cctv i sent it to my local counciler he approached the housing people she is with they said if the police wont take action we cant i own my own house and took advice to go to small claims court do you think this is a good idea also how high can i put a fence up to try to stop this can i claim off her for all the plants she has damaged and the cost of putting a fence up to stop her redoing it thankyou

    Why do you think she does this?

    Is there a dispute between you (maybe a boundary issue) or are these random attacks?

    If this has been going on a while have you been told to keep a diary of the incidents (as well as CCTV) and would an ASBO be the way forward?

      hithis woman is just doing it she has been told by the housing assocation not to do it but continues she has done for over a yr now on andoff we did have a hedge housing people put a fence up for her if we agreed to move the hedge we did but now she stands on steps and really leans over and cuts everything she can reach this is a six foot fence and all my plants she cuts down to my wall which is waist height the wall is my boundry wall we allowed them to put a fence on it she thinks anything touching her fence she has free rein on it

        She is only permitted to trim anything that overhangs on to her side of boundary, however she must return the cuttings to you as they are your property.
        In your case I'd suggest that a diary be kept and collate some photographic evidence of her if possible.
        You can then approach the housing association with the evidence. I'd also personally obtain a copy of the requirements of the tenancy agreement which the HA may provide you with. Alternatively a call to local council requesting a copy of these rules may also get you a copy. This would put you in a stronger position with the HA as you'd know what you are up against.
