  • Class action Against Lowell

Considering suing lowell/3g for harassment, breach of privacy etc, as they have been chasing me for a debt I do not owe for over 2 years and I have been very cooperative thus far but I am fed up. I have been reading through this forum and discovered a few people that have had similar experiences, I would like to find out if there are currently any people in a similar situation to me? as I am seriously considering filing a lawsuit and I know it would be much stronger if there were more people.

£100, in 2009 3 upgraded my account unilaterally so I cancelled it because i felt it was fraudulent, they accepted my cancellation and sent me a returns package, I returned the dongle and everything else it came with, and informed them that after the next payment I would be cancelling the direct debit, which I did. they then contacted me claiming they had not received the device, and would be charging me for that month (mind you this implied the beginning of a new 24 month contract, which I did not agree to). Of course I disputed this for months and they passed the account on to several debt collection agencies, one eventually admitted they had received the device, but then claimed there had been usage (which is false), most recently they are claiming early cancellation fees, and have passed the account over to lowell who have been calling me every day for the past two years and sending 2-3 letters a month like clockwork threatening everything from attachment of earnings to CCJs and I am sick of it. Its been more than 5 years and it only seems to be getting worse.

*** disputed with three for 1 1/2 years (not months)
*** also the account was upgraded when I still had about 2/3 months left and yes I did pay the remainder of the contract I agreed to before I informed them I would be cancelling the direct debit (of this I have evidence) so I am certain I do not owe anybody money and was never late on a single payment for the duration of my contract which was 24 months.
