Re: Rights on purchasing second hand cars from independent dealer

acting on behalf of road runner service centre I attended premises to carry out an inspection of the above vehicle following an engine failure
from the information supplied by the garage and the visible evidence available at the time of inspection I can confirm that the engine had developed a serious oil leak from the area of the rocker cover and oil filler

oil had sprayed over the engine and bonnet, down both sides of the engine and on to the exhaust covering the under carriage in oil
this would have caused smoke and heavy odour from the burning oil indicating there was a serious problem with the engine and the vehicle should have been stopped immediately to avoid engine failure

as a result of my examination of the engine in its present state it would appear that the vehicle was driven on resulting in complete engine failure

to give an accurate report on the condition of the engine the cylinder head and sump would need to be removed for closer examination of the components

starting to feel i'm fighting a loosing battle here, but both my reports state water loss and blown head gasket which seems much more likely yet these guys have not even done a compression test on the engine

So the report contains a conjecture that the car was driven after it would have been clear that there was a problem.
On the other hand the driver can testify that they were on a dual carriageway travelling at 70mph when the problem occurred. They stopped as soon as it was possible in a safe position at the side of the road/in a layby/on the verge?? about 500 yards further on.

You also have your engineers' reports which come to a different conclusion.

Contrary to the dealer's claim the report does not state the oil filler cap had been left off, so they are clutching at straws.

You could now use the arbitration service the garage suggest, or you could write and tell them you want your money in 7 days or you will initiate court action.
The first option will be cheaper and quicker than court!
