  • Can I claim back HSBC overdraft charges

    Hi all, and hope you can help or advise, I am in the process of trying to claim back overdraft charges from my previous bank HSBC. The amount is approximately £1700 for overdraft charges from 2004 till 2009 as I obtained a letter with these charges from HSBC. I no longer have the account with them since 2009 as I went into a debt management plan when the account was closed. I was in a large amount of debt at that time.
    I wrote to HSBC to claim these charges back and obviously thet told me they wouldn't refund me. There also mentioned the finacial ombudsman, but even I know that's a complete waste of time to contact them, as the finically ombudsman have already made a statement on overdraft charges and I believe they wouldn't look at my case anyway.
    Therefore I was looking at going to the small claims court. My only concern is the limitation act will be used against me, as it's over six years. Can anyone advise or do I not stand a chance really, not that I'm a defeatist or anything :0)
