  • A shipping container is a trespass on my land...help

    A guy has a green shipping container on land I purchased recently. The container has been there for eight years without the agreement of the previous owner and I now want him to move it.
    I wrote to him 14 days ago but have had no response.
    I would welcome any ideas/suggestions on how to deal with this.
    For instance can I move it myself, or sell it or maybe cut it up if I give reasonable reasonable notice of my intentions.

    Most shopping containers are rented. Call the company he rents it from and tell them ithat is illegally trespassing on you land and ask them to remove.
    Ifor that doesn't work then I think you have become involuntary bailee and write ton him giving 14 days to remove or he will bend charged 100 gbp per day storage. That is all I can think of.

      Older containers can be bought so the person will probably own it. Still charge him for the use of the land but say that after the 14 days you will be removing it and charging him for the costs. Contact a local scrap metal merchant.

        As i remember, you can charge them for the rental of the land, but there are some steps you have to take before remving it. Usualy, 28 days min notice is a bit more reasonable.

        Also, you have to store anything inside for a minimum persiod ( if its not empty )
        crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even

          the container is owned by him and my 14 days was for him to respond and tell me what he wants to do.....I agree, a bit more time for removal is fair.
          Inside there is just some rotting wood.....the guy has never used it.

          What I am assuming is he will do naff all and I want to be sure that I am legally able to move it or sell it myself or do I need some kind of legal/court order to do that.

            The legislation is Torts (Interference with Goods)Act 1977 (http://www.legislation.gov.uk/ukpga/1977/32)

            Sec 12 and schedule 1 part 1 are the relevant parts
            More usual to give 28 days notice
            If sold bailee must obtain market price (usually via auction but I doubt there are many buyers of clapped out shipping containers on eBay) and retain proceeds of sale (less costs) for owner

              If not taker the most likely buyer is a scrap metal company. you might get £5
