wow wasnt expecting a reply so quickly. ok in 2007 i had a personal loan with welcome. life went downhill for me about theat time divorce, busines bust sofa surfing etc. got my life back on track paid loads of old debts. then this week i get letter from a dca IND. saying an order to attend court for questioning?. I have found that IND went to court in 2013 and got a ccj against me. all this time Not 1 letter phone call nothing until now.

court summons to appear before District Judge was It, income/expenditure no doubt?

debt for? did you go to court about the case, did you know at the time a case had been issued/ if did what did you do about defence>?

i knew nothing about it until i got a hand delivered,left in letterbox. no cort date or stamp. no details at all. it was a welcome loan in 2007 . as far as i can tell ind purchased this debt and applied to court for ccj. which they got as it was not defended,how could i? i never heard about this until this week with ind letter. im going to cab on tues to see if they can help.

If this really is the first you know about it, please forgive the cynicism, you may have a very short window to try and get a set aside which depending on the amount etc may or may not be worth it.

I believe, as the letter was hand delivered it would be a very silly thing to ignore it with potentially serious consequences.

Could this be in regards to an Application for an Attachment of Earnings Order?

How exactly did you find out about the CCJ which was granted in 2013 and when did you find out?

I presume it was a Default Judgment since you were unaware a claim had been served at the time possibly to an address where you no longer lived. Feel free to correct me if my assumption is wrong

Do you mean the Welcome loan started in 2007 (before or after April 2007 if it did)?

When did you stop paying towards that loan and when would it have expired if it had run it's full term?

Sorry for all the questions but if you're looking at a set aside Application then you need to move fast.

Has IND instructed solicitors to deal with this?

And finally, how much are they persuing you for and what was the amount borrowed at inception of the loan (to see whether it should have been regulated by the Consumer Credit Act at the time).

Our posts crossed so I now can see you've already answered some of my questions.

Do you know who hand delivered the letter (court Order?) since you say there was no court date or stamp on it? What was the logo on the letter?

Is it a court document?

I'm not going to speculate what it might be if not at this stage so can you type up what the letter says word-for-word removing anything which could identify you.

hi Diana M. Thankyou for your prompt reply. I only know the loan started in 2007, not exactly when in 2007. but i will endevour to find out. stopped paying for the loan in 2007,not sure what month. I have no solicitors letters etc from IND. just this letter saying ,RE order to attend court for questioning. IND Ltd V Mr cxxxxxx I believe IND purchased this debt and applied to cort for and got ccj in 2013. this detail has to be confirmed. The original loan amount was £3000 but i dont remember what the balance was. My life was not too good at that time. ive been living a decent life these days. cleared what i thought was all my old debts. seems i missed this one. A couple of questions. If IND did purchase this debt . they obviously didnt pay a lot for it. are they likely to settle for less then the ccj,if offered a lump sum? if you feel that may work,any suggestions as to percentage wise ? What do i do with IND in the interim?. many thanks

the letter is from an agent acting for IND. its on their letterhead not IND. agent is NCIUK. reads as follows. dear mr xxxxx Re: Order to attend court for questioning. IND V MR xxxxx. I have been directed to serve you with the above order. I have already attended at the above address without meeting with you. I have to inform you that i will attend again at the address,as above,for the purpose of serving you personally withis order on ... Followed by the date he intended to call. he did unfortunatly i was out . i waited til 20 mins past the time and asumed he wasnt coming. he turned up about 2 mins after i went out.. NO court details at all. I contacted first office NCI. they directed me ti IND. I called IND they tried to get me to admit the debt. I declined. asked for details. told me debt was from 2007. i asked if that made it statuate barred. IND claim they went into court in 2013 and got a ccj. Told IND i wanted to seek some advice on this and terminated the call. Hope that makes things a bit clearer

Yes that does make things a bit clearer.

Exact dates will matter in case this debt was Statute Barred before the claim was issued. Maybe/maybe not.
