  • Neighbours downpipes

    Hi, I am hoping for any advice possible. My neighbour has guttering which overhangs my boundary which does not bother me. What does bother me is that his down pipes simply drain onto my land without him supplying any drainage for the water. Is this ok for him to do or is there any action that can be taken. I have already spoken with him about the issue and his so called builder has put some more guttering on the down pipes to simply move the issue down my land by around a metre. Any advice is possible as I am concerned the water draining from his down pipes is damaging my paved area of driveway/alleyway

      Hi and welcome.

      Perhaps you could point out to your neighbour that the downpipe is invading your airspace, and that alone comprises a trespass.
      I personally would not be happy with the guttering at ground level. If it was at roof level you could let it go, but who is going to replace it if you should happen to damage it whilst taking goods down the driveway?
      And as for diverting the water on to your land... that's not taking the p**s but giving it to you! They need to divert the water into a proper land drain.

      To keep things friendly (as you do live next door) I would suggest a conversation, but if that doesn't produce results you might eventually need to obtain an injunction.

            He converted his garage to a garden room. I don't have an issue with what he has done just the down pipes leaving water on my property.

              Bet he didn't get build regs approval! The work should not have been done in such a way that it overhung on to your property.

                Would he need building regs to convert his garage to an office? This is all new to me and the internet doesn't really help me with black and white answers

                  Contact the local council and ask that should sort this I expect there was no approval for this

                    If it was a stand alone garagehe may even have needed Planning Permission for change of use!
