  • Holiday Lets in Private Flats

    Hi all, I'm not sure if this is the kind of consumer issue that LB deals with, but I thought i'd ask anyway.

    I live in an apartment block of about 50 flats, all separate leaseholders under a single landlord. All leases prohibit short-term "hotel" lets such as Air Bnb, Bookings.com etc. One of our neighbours is working overseas and has let his flat via a mainstream lettings agent who have recently let it to a tenant and it's causing massive problems with late night parties, damage, security etc. We've found out that the new tenant doesn't live there and is subletting on several holiday let sites.

    We manage the building ourselves and have an RTM committee and have told the owner to stop holiday lets, but the owner claims that he only signed a contract for long-term assured short-hold lets with the agent, but he says that, when he complained to the agent, they claim there is a clause in his contract that allows their tenant to sub-let. So, the agent wont remove the tenant and the owner is saying that he is bound by the contract.

    Leaving aside the fact we feel the agent and owner are both in cahoots and therefore reluctant to call a stop, since his lease doesn't allow these type of lets. We feel that we are in deadlock with the agent and the owner.
    Is there anything we can do to stop it?
