  • VeeP vs. Hoist 2 Portfolio

    Hi all,

    I am currently in the middle of a drawn out battle with Hoist 2 Portfolio Holdings.

    It's for an alleged credit card debt and the amount being claimed is over £10k. So far the claimant has produced absolutely no documentation and has ignored my CCA request and CPR.

    The case has been allocated to the Fast Track and is due for hearing in November. I have the following immediate deadlines during July:


    'The parties must give standard disclosure' - by 16:00 on 12th July 2017
    'Request for copies and or inspection must be made' - by 16:00 on 19th July 2017

    Can anyone point me in the right direction of how to handle these two immediate requirements please?

      Hi VeeP

      Imho, it would be rather remiss to try & give an opinion without knowing a lot more of the background.
      Who was the original creditor?
      What are the Particulars of Claim? Was it via MCOL?
      What defence have you filed?
      What requests have you made & to whom have you made them?

      Fast Track is tricky territory for a Litigant in Person; have you sought professional legal help/advice with this?

        I'm guessing that you must provide a list of documents in your possession even if they harm your Defence?

        Ditto the Claimant.

        After that either/both parties can seek inspection of the documents disclosed.

        If this case has been allocated to the Fast Track then legal costs are now accruing. Am I right in thinking the solicitors for Hoist are Howard Cohen?

        Who was the original creditor before the debt was assigned to Hoist? You need to send them a Subject Access Request to get the full history of the account.

        In the Fast Track disclosure is ongoing so anything which falls into your possession after the 12th July deadline must be disclosed.

          What did you plead in your Defence?

          Did you include 'licensing issues'?

          What did the Claimant say in their Repliy to your Defence?
