    Hi

    I wonder if anyone can help or who may have been though what im goin though t moment.

    Cutting long story short i have HP with motonovo and i VTed back in jan 2016. I have made over 50% payments. I have a letter confirming acknowledgement of my VT car was taken it was a non runner due to battery. Although person who took it got it started and onto back of pick up. Anyway i was told id have to pay remaining money owned and it was pasted on to debt people. They told me it was due to damage on car but i got proof the damage was there when i brought car. I received email today from debt people saying im not being changed because of damage but because i voluntary surrendered my contract and not voluntary terminated my contract.

    Are motonovo trying to pull a fast one?

    In short, yes. Does the acknowledgement state voluntary termination or voluntary surrender? Also have the debt collectors put it in writing that they are chasing you because of voluntary surrender not VT?

    Motonovo seem to be doing this quite alot so you might wish to make a formal complaint to them and explaining that you terminated the agreement in accordance with section 99, a copy of the letter they would have on file which explicitly says that. They have passed your information to third party debt collectors whom have said that you owe the remaining balance on the agreement because you voluntarily surrendered the car, which you consider deceiving and fraudulent.

    You should explicitly make them aware that the letter or email is to be treated as a formal complaint to which they have 8 weeks to investigate and if the complaint is not upheld, to provide detailed reasons why. If they fail to respond within the 8 weeks or if you are not satisfied with the outcome then you will refer the matter to the Financial Ombudsman and seek compensation for harassment, distress and inconvenience.

    You should also tell them the result you are seeking e.g. confirmation that the account is now closed and that they accept the agreement was terminated in accordance with section 99 and no further liability is owed.

    Or you can bat responses back and forth and see what happens.

      If u can see my attachment u will see that the very first letter they sent me after i sent my VT was this.

        Based on that, it definitely says voluntary termination so if you do send a formal complaint, I would include harassment to your letter as well.

          This is a copy of the email the debt people sent me after i sent them an email confirming the damage on the car. It took motonovo 4 months to reply back to damage email and this was the reply.
