  • Link financial outsourcing

I have received a letter from Link Financial Outsourcing re an outstanding debt. I sent them CCA request and they have responded saying they do not need to provide info as this was subject to a CCJ - the problem is I have no recollection of this ccj ?? The creditor is Lloyds bank but I have never had a loan/credit card with this bank - any ideas/ letters I can send to query this ????

If you have a CCJ by default, it may be possible to have this set aside.
Check via Trust Online for details of the court hearing venue, claim number etc..
Contact that court to get further details of the judgment.
Then write to the Claimant/Judgment Creditor for their consent to set aside.
If they refuse or ignore, you can make an application for a set-aside without consent.
You will need to act fairly swiftly, as delay could defeat the application.

I have checked online - I did it on my current address (I have lived here for 17 years), and it doesn't show. Link have given a case number - could I just ring Northampton to check it ??

          How old is this CCJ?

It could only be against my old address, which I moved from 15 + years ago, because it would have shown on Trust Online wouldn't it ??

Rather than applying for a set aside, might've it be worth sending the statute barred letter ???? Any ccj would be 10years + old ???

once a CCJ is in place you need to set a side, there is no side step the issue, no need for letter table tennis, as advised send letter asking if they agree a set aside if not go ahead anyway these bally chancers must be near out of business after such long time CCJs, desperation??

Why don't you simply write back to Link asking them to provide you with evidence of any CCJ.

                  Make it a one-liner

CCJs don't go statute-barred, though if it's over 6 years old they would have to jump through hoops to try & enforce it.

Short and sweet. Like it. The debt is only 400 so don't really want to waste 225 applying for a set aside.

                            Just want to add
In the mid 1990's I was given two CCJ's which I paid at the agreed amount until 2012 when i contacted both creditors and asked what would happen if I stopped paying. Barclays said nothing as it was so old, the other sent me a couple of letters the went quiet that was nearly 6 years ago.
