    I have received an enforcement notice saying that they have photographic evidence of my car being driven whilst sorned, they have offered an out of court settlement of £305.
    The car was actually being driven to a garage for a pre MOT inspection and was actually taxed the following morning from the start of the month which covers the day that the car was photographed, what do I do?

    Hi and welcomed
    Was the MOT test pre arranged?
    Was the garage doing the pre MOT inspection also the MOT station where the car was tested?
    If it was a different garage was the car tested on the same day?

    You are allowed to drive a sorned vehicle to a testing station as long as the test was by appointment.
    So if your testing station is prepared to confirm you were taking the car for a prearranged test you can decline their offer to pay £305!

      It was being taken to the garage for a Pre mot inspection, unfortunately the MOT test was carried out when it expired a week later.

        In that case the car should not have been on the road and I doubt you can escape the penalty.
        Others might have a view on this.
