But the CCJ wasn't served correctly hence the set aside application for hearing was granted ?

Presumably the hearing for your set aside was granted because you made an Application and the Claimant decided to contest that?

The fact that your Application was listed for a hearing didn't mean that the court would have decided the outcome before the hearing takes place. The hearing simply means the court wishes to 'hear' from both sides before any decision can be taken.

Did you file a Witness Statement and Draft Defence with your set aside Application?

That's when/where you would have set out your case with exhibits/evidence to back up your reasons for the set aside and why you believe you would have reasonable prospects of success if you were to be given the opportunity to defend the claim.

Did the Claimant file a WS before the hearing?
