    Now you've received their Defence can you say on what basis are they hoping to contest your claim. Is it because they feel they don't owe you any money or some other reason such as the wrong company name in the POC etc?

    Has the Company/Defendant instructed solicitors?

    I think we need to get more info from the OP, there may well be some points which can be challenged but without further info from the OP we are just guessing which is probably the most dangerous thing to do with litigation , just look at how debt purchasers litigate haha

      I agree, and that's why I also asked if the Defendant had instructed solicitors since the OP is a LIP making it a David v Goliath situation (I saw your and Jo's tweets this morning )

        Indeed, but the problem is, the LIP generally will only be armed with limited info that they have gleamed from places like here, but they wont be able to think on the go. I assisted a case in 2011 where i attended to represent the Defendant, the Claimants advocate tried to salvage his losing position by arguing that Manni Investments was a case which acted as a proposition that the bad default notice could be overlooked.

        Fortunately not only was i aware of Manni, and that it was a landlord and tenant authority on notices to quit, but also i had just won Harrison, and had a copy with me so was able to argue the advocate was wrong. I won, but the consumer would have lost if he had been faced with the legal argument that i had to deal with.

        Its a major probloem
