    I received a letter from shoe smiths about a debt I have from Tesco credit card.
    The letter informs me that I have failed payments and the agreement is terminated and the client requires proposals for payment. Please treat this letter as notice that unless an agreement is reached within 14 days of this letter we are instructed by our client to commence proceedings. It also states we maybe able to agree to accept less than the sum outstanding as settlement.
    ;Any advice on what to do?

    Send a s. 77-79 CCA Request to Cabot asap with a copy to Shoosmiths solicitors.

    When did you open the Tesco credit card account and how much is Cabot chasing you for?

    Did you have PPI on the account?

      March 2007 and owe £6000 . They are chasing for the full amount. They've only had the account for 4 months.
      Tesco still reporting on credit reference as well as caboot. Defaulted 5 years ago but paying Tesco until 3 years ago.

        March 2007 as an account opening date could be helpful.

        Send the CCA Request immediately because a £6k debt is likely to attract the attention of Shoosmiths Solicitors. Hopefully the CCA Request will make them pause while they search for the paperwork.

        In the meantime also send a Subject Access Request to Tesco Finance so you get the full history of the account right up until it was assigned to Cabot. This could prove invaluable if they do issue legal proceedings in the future.

        If you were paying up until three years ago you've got a long way to go until it will become Statute Barred but if they can't produce the documents to comply with your CCA Request then they can't enforce the debt unless or until they do.
