  • Bankruptcy Petition

buried my head in the sand a bit on this one for a year due to a health issue unfortunately but essentially ive had a statutory demand served and now subsequent a petition for bankruptcy. the debt is from a personal guarantee i signed for a business i was a director of that failed around this time last year triggered by a wind up order served by the same creditor.

i have some points to explore including the wording of the original agreement that i signed, of which im sorry to say my copy became mixed up in the business paperwork during the insolvency process and i lost track of it. at the time of liquidation i consider my health issue didnt allow for my involvement in any meaningful way.

im considering opposing the bankruptcy petition and a see this as a starting point though im unsure what the best way of finding out what paperwork was submitted to the court for the statutory demand to be issued. assuming this would be the original signed agreement and it is this document that the judge based his decision on.

i have a court date early may, assistance will be appriciated
