  • Need a copy of the court's decision

    Hello… I need a copy of the court's decision following a hearing for summary judgement… will this be sent as a matter of course, or do I need to make a request?

    Hi Dookist,
    An Order would have been made by the Court for Summary Judgment, so you should get a copy of that, as one of the parties. It can take some time for it to come through, but if not received in 2-3 weeks, I would contact the Court. Depending on the type of case, the Court may have made certain directions that need to be complied with in addition to giving summary judgment, so it is important you get a copy of the Order, particularly if you weren't at a hearing.

      Thank you very much for replying… I did attend but I have to wear a hearing loop and the air conditioning was drowning out a lot of the speech.
      I know that I have to provide an amended POC but without a copy of anything relating to the decision, not even the directions order telling me what I need to do, and having to file and serve the amended POC by tomorrow in order to meet the 14 day time limit, I am at a loss as how a LIP is to comply with directions having had no sight of them in spite of two emails to the court. They certainly don't make it easy, do they?!

        Hi Dookist,
        I'd get on the phone and see what is happening. Explain you believe directions were made at the hearing, but haven't received a copy Order yet so don't know dates for actions. They should at least tell you if it has been sent yet. Maybe it has been lost in the post? I'd mention that you believe there are directions to comply with that you understand are quite soon but without the order you can't deal.
