If it were that simple I would be out of a job

What is the claim for and what have you pleaded in your Defence? Or if you are the Claimant what have you pleaded in your POC?

If you've received a Witness Statement but not yet filed yours (they're supposed to be exchanged simultaneously) could this mean the other side has filed theirs early (perhaps to intimidate you with the contents) or you have not complied with the court's Directions to file yours by a certain date?

A little bit more information will help.

We are the claimants and are pursuing monies we believe are owed to us.

We have issued and received witness statements, but need to respond to the statement we have received.

I am not trained in these matters, so I am unsure of the format this should take. I assume this enables us to question the witness statement received.

What is the money owed for?

And why does the Defendant think they shouldn't have to pay it?

The defendant cashed a cheque which we beleive they were not entiltle to. they are claimin the right to set off

That's not a lot to go on

Did you (Claimant) write out a cheque to them (Defendant) which was post dated or something? Why weren't they entitled to cash it and what are they attempting to set it off against?
