    Hi

    My husband did not register our marriage as his divorce was not granted when we got married in the catholic church in Scotland.
    Does this mean that he has committed bigamy? Does this also mean I have never been married under Scottish law and we are both free to marry again?
    Please can you help

    When were you married?

    Did the minister of religion give a certificate of marriage to both of you?

      The Church you were married in should hold a register of marriages held there.
      Most (if not all RC parish priests) are authorised to conduct marriages

      So, except for the fact your ex was not free to marry, you would have had a valid marriage.
      As he was not free to marry, I assume that was why he took steps to ensure it was ot registered

        So he was not free to marry at the time and therefore it was a bigamous marriage. Therefore you are not married. No doubt he had to declare that he was free to marry, this suggests something like perjury
