  • Default Notice Times

    Hi
If I receive a DN (on a Credit card) saying I must remedy within 28 days, then they terminate the agreement after 14 days, does this make it invalid?
    Thanks

    Re: Default Notice Times

It would mean wrongful termination, yes

Was it 28 days from the date of the letter to remedy the issue? And did they terminate 14 days after that date or 14 days after you received the letter?
If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. Please do not hijack another person's thread as I will not respond to you

        Hi
They terminated 14 days after I received the DN, but they gave me 28 days to remedy the Default on the DN.
        DN dated 12th
        Termination dated 28th

OC sold the debt a few years back.
        Thanks for the input guys

Typical regulator interpreting an act they way he feels is fair(!) and not according to what it says.

CCA 1974 sec 88 (2) clearly states the date must not be less than 14 days (so can be 28 days), and that the creditor "SHALL NOT TAKE ACTION BEFORE THE DATE SO SPECIFIED
