  • Misconduct in public office ?

    I had a CCJ that instructed me to remove my boat from the waterway owned by the canal and river trust or obtain a new licence, which i complied with, however , one of the trusts senior officers claimed that the order barred them from ever issuing another licence to me, i found out this was not true, and contrary to the 1995 BW act section 17, and forced them to comply with the law, the officer claimed he didnt know the law he was specifically employed to impliment, which is laughable. After this new licence application they deliberatly inteferred with the application so that it took 126 days to complete, in which time they breached both statute, and their own terms and conditions .

    The Trust is a charity, but their statutory duty to issue licences is a public function, so is this officer in " public office " and is he liable to the offence of misconduct in public office ?

    If so how can he be prosecuted ?

    I'm having difficulty getting a straight answer about Misconduct in a Public Office too, it seems a grey area of the law. This might help;
