**DISMISSED!!** Urgent help - hearing 10/11

Hoping you can help

I have a hearing on 10/11 for a Capital One debt - have contacted the Court and advised Lowells filed statement on 03/11 - 7 days late and have not served on me.

Just received a copy by email

They have provided

Copy of original agreement dated 2006
Copy of payments - last payment made 18/09/2012
Copy of Statement of default dated 15/10/2012
Copy of Notice of Assignment although they accept they are unable to produce the original and is a sample one

I think I have to pay? Any ideas?

Hi,

Is that agreement compliant with the CCA request, e.g. Is it easily readable in all parts, are the terms and conditions the correct ones?

Would be a good idea top post a copy here now after removing personal information.

I don't know how to upload - essentially my signature appears ok and it isn't readable as the writing is so small but it may be the quality of the scan.

Also the Notice of Assignment is a blank one and the statement they have filed says it would have been similar to this one - is that good enough?
