  • *WON* !!! Claims handler timescale query

    Hello,

I've noticed a few PPI questions on here but non that seem to cover what I want to know so here's my question if anyone could help?I

'm just querying how long a claims handler can claim access to monies after the initial claim has been refused and case closed?

In short, PPI claim made via handler, was refused. Advised to use ombudsman but did not want to go down that route (too much to deal with at the time). Case closed.

Almost two years later, Barclays (original bank in respect of claim) decided that they were going to re-open the case and have since decided to pay out which had nothing to do with the claims handler but they are still claiming their 30% plus VAT which I want to dispute due to them not actually doing the work to get the money back.

My theory (based on old business law course from a few years ago) is that the contract ended between the two parties the day the initial case was closed and we did not want to go via ombudsman route. The fact that Barclay's have decided to re-open the case themselves is nothing to do with the claims handler. Would this be correct or am I fighting a loosing battle?

    Many thanks in advance.

    Re: Claims handler timescale query

The Claims Management Regulator has indicated that CMCs cannot charge fees for claims that are initially refused but subsequently reviewed & upheld by the bank.

Hold on, I'll get the document...

        Re: Claims handler timescale query

Thanks very much. I will send this link to my email. This is really appreciated. I did think it was very cheeky for them to stake a claim on this final decision :0)

              Re: Claims handler timescale query

Ahh they're solicitors so won't come under the jurisdiction of the Claims Management Regulator. I'll see if I can find their T&Cs.

No problem. I will need to access the letters from home (as at work today). I will see if I can find the original engagement letters tonight and upload / scan them in tomorrow for you :0)

                      Re: Claims handler timescale query

Apologies about the delay in getting back to this thread. I'm doing this on behalf of my other half and he's not as quick as me for trying to sort things out!

I've managed to get a link to their standard terms and conditions and we have requested that they send a copy of the original documentation too but for now all I have is the link for the standard T's & C's. I hope this is helpful?

Unfortunately those T&Cs are just for the use of their website. Let us know when you get the documentation.

                            No probs.

                            Also in your first post:

Do you have any letters from GW saying that the case was closed?

We've got a letter from Barclays advising case closed but I'll check with the other half (OH) about from the GW. My OH called Barclays who advised that it was them that decided to reopen the case and not GW. Thanks
