  • Subject Access Request

    Hi. I've just found and joined this site. My partner is being chased by Lowells for an alleged debt owed to BT. We have asked several times for details of when and where this alleged debt relates but no joy. Finally we seem to have stalled Lowells by entering into their formal complaints process. Still we don't know the details of this alleged debt. I have seen reference to SAR. Does this require the DCA to supply details of the debt? I note they have 40 days to comply. Does this give them time to lodge a claim in Court before providing the information? I assume that a defence in any proceedings would be that we don't know what the alleged debt relates to and Lowells would have to provide this information prior to any proceedings. Any help would be appreciated.

    Good morning, welcome to LB,

    A Data Subject Access Request is for " personal " data only, and when debts are sold it is with the absolute minimum of data, so it's unlikely that Lowell will have much information.

    It may however be better to send a SAR to BT this would cover all accounts you may of had with them.

    You are correct in that Lowell would have to provide documentary evidence that the account exists and the debt is enforceable.

      A SAR is better sent to the original creditor (in this case BT) ... Lowells are unlikely to hold much information regarding the debt as they buy large portfolios with the barest minimum of detail

        Many thanks. In the circumstances I may wait until I hear back from Lowells. I've already incurred expense sending letters recorded delivery (signed for!!) To no avail. Although we have no knowledge of the debt, I suppose it is possible that my partner omitted paying a final bill at one of her previous addresses. In which case she will settle. But we don't want to pay when we don't know what it relates to. I may well come back to the thread if things move on. But once again many thanks. Really impressed with the speed of response.
