  • Builder & Remedial Work Outside of Trading Hours

    Good Afternoon,

    I am hoping someone will be able to give me some advice here.

    Briefly, a builder built an internal office at my commercial premises. Internal doors do not shut. After 6 weeks of texting requesting a fix, and then sending a letter, he finally comes around at 8am on Saturday and agrees they need fixing. However he only offers to do this outside of our normal opening hours which are 9-5 Monday - Friday. We are open 40 hours a week - it is unreasonable for me to expect him to rectify this within these hours? I would otherwise be paying staff wages to sit and watch him work!

    The first place to look would be your contract.
    Did you use a standard JCT contract?

      You may have to reach a compromise with him can I ask why more than 1 workers needs be there .
      Talk to the builder before you look at any other action

        You are the customer so it is not unreasonable for you to expect the remedial work to be carried out at a time that suits you. Saying that, being a plumber who works in a lot of commercial buildings, it is far easier to carry out noisy, messy and potentially dangerous works when there aren't the concerns of others so much in your mind. I remember taking two hours to drill an hole in a shelf in one office because I had to work around the office making phone calls, wasn't really productive or efficient for me or the client. The contractor should be pleasing you but maybe compromise if the bigger picture is more beneficial for out of hours .

          We reached a compromise, at last. 8 weeks just to get a 30 minute fix done!
