  • Mothers Last Will and Testement

    I am the eldest of 3 daughters, and during the 6 years that I spent 90 days abroad, 90 days in the UK, my mother made her will and appointed my two younger sisters as executors. (my mothers say because I was abroad at the time)! I have only just discovered this fact. My youngest sister and I didnt speak much over the last few years until recent months, and worry just how much influence she has had over my mothers will making.

    1. Is it possible my sisters know what it is in my mothers will - I dont even know where it is kept and when asked my mother this question she said my youngest sister knew the solicitor and where the will is.
    2. Is it possible they can execute the will and distribute without me being involved at all?
    3. My mother doesnt have much in the way of savings, but she does have a large property which she still lives in and owns, can my sisters claim rights to the property and leave me out.
    4. If I am not mentioned in the will at all (even though my mum has indicated in the past that I am), is there anything I can do to claim what I believe to be my share of her estate?

    I feel very upset about all this, but can't ask anyone in the family for help.

      Hi and welcome,

      It's sad to hear of incipient family disputes, especially over the future death of a loved parent.

      At the moment there is nothing you can do to force disclosure of the will's contents, whether or not your sisters are aware of them.

      After your mother's eventual passing the executors will need to obtain probate .
      When probate has been granted you will be able to obtain a copy, if you haven't already done so.
      At that point you will discover if your mother has left you out or not.

      Why do you fear your younger sister may have been able to unduly influence your mother?
      If the will was drawn up by a solictor you may have trouble proving that point.

      If your mother has omitted you from the will, you might be able to claim provision from the estate under the statutory authority of the Inheritance (provision for Family and Dependants)
      Act 1975

      However all that is in the future, and in the meantime would it not be better to attempt to improve your family contacts?
