    From the way you describe things it's not just about the money, it's about family baggage too. It'll be difficult to come up with a resolution that can please all involved.

    Have you considered trying Mediation as a way forward? A skilled mediator will allow everyone to get things off their chest (like old resentments) before doing any number crunching.

    Does Nick really want Bill to move out of his home where he has lived for decades especially if that results in them loosing all contact with each other?

    If you get lawyers involved there's a risk that a huge chunk of the money realised will go to them not Nick or Bill or you.

      We really want to move now it's a four bedded detached with a massive garden
      Just over an acre, so we are getting older near 60 so can't raise a mortgage and haven't got a lot left out of the inheritance that I was left. So need the money back to buy another property. We have said we will sell the house all I want is the money back or a bit less and then sell give me the money and this can go for our new place, and then split the rest 50/50 he will get more than the house was with on probate . So not a bad days work no upkeep and nothing given for Windows ect and motpre money than it was worth on moving out
      the value when probate was done didn't take into consideration that the house hadn't been decorated since 1965 until I moved in in 2001 lol

        He has been here but totally ignores me, bill was in an accident at work he inhaled chlorine gas, I put it on Facebook he asked me how he was I told him to ring. He did but bill went a bit wobbly talking to him. And they hung up, Bill was bullied by Nick and Bill has dyslexia so has trouble with conflict. Nick want us out we can't pay him off as dont want a mortgage and we are coming up to 60 in a couple of years. We are willing to move and settle with him but it's my money is the sticking point the house was valued by two estate agent one was 395k and the other was 425k

          He may argue that the fact you've had a roof over your head for all those years compensates for the effort you've put in (not the £50k financial/renovation costs).

          He could say you haven't had to pay rent or a mortgage to live elsewhere, with all the associated maintenance of that property, while he has (or hasn't he?).

          Fighting to secure the £50k you invested and the uplift in value as a result seems to be fair.

            I would get it valued by at least three estate agents since their views will vary depending on a quick sale or whether Nick is willing to sit it out for a little bit longer.

            A house with an acre will be worth more in the Spring market. Sales after November tend to slow down as buyers typically want to be in before Christmas or leave the big move until the following year.

              He has his own house in Edingburgh with a small morgage on it, he used to work for a bank but it's not fit to live in, as he is a horder so I doubt he has spent any money on his place.

                Hi everyone things seem to have changed so anymore help would be great I am now very worried, I managed to contact nicks friend, apparently on Monday he has a meeting with Fife social services to ask for funding to get a court order to force us to sell the house. I don't know anything about Scottish law but surely the court will need all the information on the case before putting a cout order in to force sale, we have already told him through solicitors that we are going to sell but just need a figure on the maintainance costs
                any thoughts or help will be apprecieate do thanks you

                  Hi hi thanks for all you advise but things have changed. Nick has a interview with Fife social services as he is registered with them, he is asking for funding to obtain a court order to force sale of the house, can he do this without any warning , surely they should look at the solicitors correspondence which says we are waiting to put house on the market but are waiting for Nick to agree to monies owed, which he will no do.scotish law is different than English law I believe do the courts in Scotland have jurisdiction in England

                      Yes the house is in Derbyshire , he lives in Scotland he own his own home there
