  • Business Dispute (the route to court)

I have a limited company. 50% split share with a business partner. She has broken the contract on many levels. I have sent her a notice to remedy the breaches and she has failed to do so. Which means “event by default” that we get the company valued and I buy her out. She does not want to go to mediation or settle outside of court it seems. As I have done my best to resolve this matter outside of court.

I can’t value the business as she is diverting money and I can’t track the money currently, she may have sold company assets without consent also.

The business is currently running however she has changed passwords to prevent me access to company emails, documents, sales etc.

    Breaches
    · Changing Passwords & preventing access to business accounts
    · Transferring large amounts of money into her account
    · Diverting funds
    · Changing a name of a company asset into her personal name (may have sold assets)
    · Employed someone without right documentation

I am looking to remove her from the business and force her to sell. I will be representing myself in court as the solicitor fees are way too much.

    What I need help with:
    1. I need to know the court route
    2. What court form I need fill out
    3. More information the better

    Thanks in advance

if she is diverting funds to her personal account thats theft and you need to call the police.
X Speak to the bank and see if the account can be frozen. I think you also need to speak to a lawer. Your personal or company insurance may cover this . Get hold of an IT expert they may well be able to crack the new password. Most people use weak passwords even for important things .
