  • How to challenge CCJ / Attachment of earnings

    Hi all,
I need some advice on a CCJ / attachment order. I'm not going include all of the details on a public forum, but hopefully enough to get an answer.

I had a PG on a business loan from a bank which was defaulted on. The case went to court and a CCJ was issued to pay the PG. I wasn't able to do this, but about 6 months later found some information about the loan and the guarantee which I felt showed there was some information to dispute the claim. I appealed the CCJ but the appeal was rejected at a hearing as it was issued over 6 months after the original CCJ (out of time).

More recently, the bank got an attachment of earnings order against me. I haven't yet paid anything and I'm still within the 16 days to appeal.

I have some information that I've obtained which shows that the amount that the bank are claiming that I owe is not correct (they're claiming about twice as much). I sent an N244 form to the court to appeal, but this was rejected as my previous appeal was rejected.

So my question is - what is the next step to appeal this judgement based on the fact that the amount is incorrect and secondly, that I don't think I owe the amount in the first place.

Thanks for any answers in advance - I'm not looking for specific responses on the details of this, but more of what the legal process is to try to get this overturned given the fact that the previous appeal was rejected.

Apologies - I meant to post this in "General Legal Issues" - can someone move it?
