You pleaded SB in your Defence. That was enough. I wouldn't expect Mortimer Clarke to agree to Discontinue until they've carried out their own research into the facts. It seems you wrote asking them to Discontinue on the same day as you filed your Defence which was a bit optimistic and a tad premature in my view.
