    Okay, that all makes sense

    Your WS deadline is 10th October.

    The Claimant has to comply with your CCA request by 11th October.

    This means you can't accuse them of non compliance in your WS.

    Your pinning everything on your SB argument.

    Tomorrow can you post up the POC and your Defence (redact any personal stuff).

      Particulars of Claim:
      This claim is for the sum of XXXXX in respect of monies owing pursuant to the consumer Credit act 1974 (CCA) under account number XXXXXXXXXXXXXXXXXXX
      The debt was legally assigned by Santander UK PLC to the claimant and notice has been served. The Defendant has failed to repay contractural paymennts under the terms and conditions of the agreement. A default notice ha been erved upon the Defendant pursuant to Section 87 (1) CCA
      The Claimant claims .
      The sum of XXXXXXX
      2. lnterest pursuant to s69 of the County Court Act 1984 at a rate of 8.00 percent from the 24/04/2016 to the date hereof 30 days is the sum of 88.26
      3. Daily interest at the rate of 2.94
      4. Costs


      The defence I put forward was that this debt was statute barred in layman terms and the claiment handt provided me with any evidence of the payment(i hadnt found the website) Can I enter a redefined defence but tating the same principals?

        I Have just spoke to the mediation team and they have just said its not suitable a its over 10k even though the judge has recommended it. My cca request as been returned also with the pound postal order saying that all documents will be requested by Howard Cohen as part of the process of the county court claim. all I can really do now i prepare my pack and see what they put in theirs.

          What's the hearing date?

          And has the claim definitely been allocated to the Small Claims court despite it being for over £12k ?

              Hi Iam about to enter in my pack and I have a couple of questions.

              if my date of hearing is the 24th I take it my pack has to be with the court on Monday the 10th (14 days before)

              Do I put a copy of the claim, directions etc in the pack or just the documnets to be used and witness statement
              .
              Am I able to amend my defence, still using statute barred but adding in more information (I think I know the answer to this!)


              Once I receive the claiments witness statement and docs and I decide to try and settle do I speak to Hoist, Robinson Way pr their solicitors?
