  • New Member with Decree problem (scotland)

Hi All, this is a great site, and a fantastic source of information, i feel there is hope to my situation when i read the forum!

i would appreciate advice relating to a Decree/CCJ i have just discovered on my credit report, i knew nothing about it, and it relates to a credit card debt claimed to be owed to MKDP llp for £11000, this was issued in Sept 2012, i cannot recall ever receiving paperwork relating to this, and i dont recognise the debt.

i have found the debt agency who appear to now own the debt are Link Financial for MBNA, I made a request under the CCA 77/78 for the agreement ( i sent £1), they have replied as follows:

we write further in the matter regarding the MBNA credit card and to be more specific your request for account documentation under section 77/78 of the CCA 1974. Unfortunately the original creditor is unable to comply with your request. we therefore return your fee payment of £1.00.

can i apply to the court to have the decree overturned?

is there anything else i should be asking Link financial for?

    any advice greatly appreciated
