    My partner is a permanent employee at a company in Scotland. He was recently signed off by his GP with stress & depression, he is certain this is caused by the workplace. He feels well enough to enter another job but not to return his current company.

    He is awaiting the outcome of a recent interview at which he did not disclose his current sick leave (half way through two weeks sick note). The company he is currently employed by only provide basic statutory sick pay, one of many examples of their lack of interest in employee welfare (along with 1% pension contribution and lack of basic facilities if you're interested). We are not able to survive on one third of his former wage and he will not be eligible for benefits if he resigns.

    The best outcome here would be that he is offered the new position and is able to avoid his notice period (one month) possibly using sick leave, holidays and/or unpaid leave.

    Unfortunately, the CV he provided to the potential employer includes a reference for his current position.

    1. Can his current employer disclose his current sick status to the potential employer?
    2. Can his current employer disclose the reason for his sick leave to the potential employer?
    3. Can he request a change in his references to the potential employer?
    4. Can my partner request a sick note for the duration of the notice period based on the fact the workplace is the cause of the problem?
