  • Court claim for terminally ill

Hi I'm looking for some help please.
my uncle is now in full time nursing care in a care home due to having terminal cancer with a prognosis now of a couple months.
he received a ccj claim the other day to his address from Reston solicitors on behalf of arrow global for £3000.
obviously he is not in a position to deal with this in his condition so I was looking to see what we should do as to a response?
any help in this situation would be much appreciated it's stressful enough dealing with his end of life at present let alone dealing with a court.
    many thanks
    Phil

I'm sorry to hear this. I agree a court claim shouldn't be a priority at a time like this but it would be good to find a way to deal with the situation to give all of you some peace of mind.

Can you say what the claim is for (credit card, personal loan, overdraft etc).

Has your uncle made any arrangement for a family member to deal with his affairs such as a letter of authority or is he too poorly to do that?

      Hi

      thanks for your reply.

the court form just says for HSBC credit agreement from 1987 doesn't stipulate overdraft, credit card etc.

dosnt mention any default dates but he has not had a HSBC account since before 2010-11.

he unfortunately is not in a position to appoint anyone being bed ridden on strong medication.

he is single with no dependants.

      any help much appreciated

      phil

Oh dear I did reply to your thread earlier but it seems the Cookie Monster may have not accepted it. Maybe it's an iPad incompatabiity thing

I'll reply again in the morning but can you clarify whether your uncle has made a Will? Any creditor claiming against an estate may still have to prove the debt claimed is enforceable in law.

Do you know whether there are likely to be any other 'debts' which may surface?
