    Hi there

    I hope someone can give me advice before I explode at Anglian Water as I would prefer to do this calmly and get a satisfactory result.

    The background is this: I moved in with my (then) girlfriend in 2003. It is her house (owned on a mortgage). We split up in 2009 but very amicably as I took a contract initially in the US for 18 months and at various other places around the world for the last 7 years. However as I have no fixed abode I have always used the address for service (UK bank account, electoral role etc) and actually had some of my stuff kept in the garage until 2012.

    Back in 2011 when back in UK for a couple of months I discovered that Anglian Water had registered a CCJ against me and the ex jointly for an unpaid bill. I contacted them to explain that I did not live there any more. They said I was on the bill and as I occasionally visited and stayed at the property when back in England (about 10 days in 2 years!!) that I was liable for the debt. I didn't agree with them and asked for them to remove me from the bill but that I would give the ex the money to settle the outstanding amount. As I was at the time going back overseas I wasn't particularly bothered and thought nothing more of it.

    I have been back in the UK for 3 weeks now and have been looking into buying a house to rent out. I have a sizeable deposit saved up from the years working abroad so thought I would be able to get a pretty good rate. Unfortunately I have been to see an IFA today and discovered that Anglian Water have kept me on the bill and I now have 4 CCJ's and a couple of defaults from them on my credit file the most recent being from January this year.

    I have a copy of the email communication with Anglian Water from 2011, what should I do? I have read that it costs £235 to apply to have a ccj set aside which would mean I would have to pay £940 which seems unfair.

    Just an update as I have spoken with the ex this evening. Apparently Anglian Water have a charging order on her property for the outstanding balance. Confuses me even more as to why I am involved in this.

      Hopefully someone will be able to help me now...

      I have spent the last couple of months in email exchange with Anglian Water. I finally have agreement from the CEO of Anglian Water that I'm not liable for the charges for the period I stated. However he says whilst they are removing my data from credit reference agencies, that I will have to apply to the court to have the CCJ's removed myself. Surely that can't be right, can it? That will cost me over £1000 just to rectify their mistake.

              Best thing to do is get the paperwork on here and we'll have a look at it, how much is the debt now and get proof, to show that you was not at the property at the time.

                As you have reached agreement with AW I think (but am always open to correction:santa_smiley that you need a consent order.
                This sets out the agreement that the dispute(s) are settled, the original claims are withdrawn and the judgements are to be set aside.
                Consent order sent to court with £50 fee (?)
                Hopefully court endorses order and CCJs removed

                Other suggestions anyone?

                  Yeah you'll have to appeal the judgment to be set aside, and hope for the best.

                    Thanks guys. I have already sent the info to AW which they have accepted as correct and that I have no liability for the property in question. Would I be better off just applying for the set asides and then can I also claim the fee back through court as they have accepted they are in the wrong?

                      If you can obtain AW's agreement to a consent order it might well save you the costs of applying for set asides, and then the hassle of trying to recover the costs from AW.
                      IMO it has to be worth a punt, but I'll tag others with more knowledge
