    Hi all great to join the forum,I have recently opened a claim via the mcol against a customer who won't pay me for work I carried out at her property, I sent her an invoice and cover letter stating she had 30 days to pay or I would start court proceedings, I have had no reply so registered with mcol paid the fee and submitted the claim,when I filled in the particulars of claim form in my haste I left out important information I.e. dates I carried the work etc etc,I'm expecting the court to reject my claim due to the lack of information, what I would like to know is if the claim is rejected can I start the claim again and paying the fee or just going to the county court directly and start a claim from there?

    Hi and welcome

    The Particulars of Claim only have to include a concise statement of the nature of the claim.
    The very detailed bits come later when you write your witness statement.

    Don't start panicking yet!

      Haha! I'm not at the panic stage yet but pessimistic is probably closer,I'd still like to know what the procedure is,the internet is a total minefield on the subject of small claims I've given up trying to navigate through it

        If the defendant's defence is that there is insufficient detail to put forward a defence, you will be able to reply to that.
        If you want you could make an application to the court to amend your statement of case CPR17.

        However as this is small claims and you are a litigant in person IMO you should wait and see before taking any action.
